Draft: not yet in force. These terms take effect when ElectionKeeper launches publicly.
Terms of service
Last updated November 4, 2026.
These terms apply when you use ElectionKeeper ("we", "us") to run elections. By creating an account, you agree to them. If you use ElectionKeeper for an organization, you agree on its behalf and confirm you're allowed to.
Accounts
- You must be 18 or over to create an account.
- Give accurate details, keep your sign-in secure, and tell us straight away if you think someone else has used your account.
- You're responsible for what happens in your account and in organizations you own.
Organizations and roles
- An organization's Owners control it: its members and their roles, billing, and deletion. Every organization keeps at least one Owner.
- Owners decide who gets access. Deputies and Viewers can only do what their role allows.
- Owners can invite observers to an election. Observers can watch it and sign off the report, but can't change it.
- Some actions, such as revealing voter keys or unlocking results, require two-factor sign-in.
What ElectionKeeper is for
ElectionKeeper is for community organizations, such as clubs, student unions, associations, co-ops, nonprofits, boards and committees, voting under their own rules. It isn't for public or government elections, or for any vote that the law requires to be run a particular way.
Acceptable use
You agree not to:
- upload voters you don't have the right to contact about the election, or buy, rent or scrape voter lists;
- use invitations, reminders or announcements for anything other than the election, or send spam, phishing or misleading messages;
- impersonate another person or organization;
- split one group's electorate across several organizations or elections to stay under a plan's limits;
- try to see how anyone voted, interfere with an election, or get around limits or security controls;
- probe, overload or attack the service, except through responsible disclosure to security@electionkeeper.com;
- break any law, or help anyone else do any of these things.
If an organization's email draws a high rate of spam complaints or bounces, we may pause its sending while we look into it.
Voter data
- You're responsible for the voter lists you upload: that you're allowed to use them for the election, and that they're accurate.
- We handle voter data only to run your elections, as described in the privacy policy, and delete it on the schedule set out there.
Elections and results
- You decide your election's rules: who's eligible, positions, methods, schedule, write-ins and how you resolve disputes. Make sure they match your own constitution or bylaws.
- We count ballots using the method you chose for each position, as described on How it works. Deciding what results mean for your organization, and any disputes about them, is up to your organization.
- Once an election launches, some settings are locked so the election stays fair.
- Strict elections: you're responsible for keeping the results key and its recovery code safe. We never hold that key, so if every copy is lost, we can't recover the results.
Payments and refunds
- Prices are in US dollars and shown on the pricing page. Payments are processed by our payment provider, Polar.
- A per-election purchase is fully refundable until that election launches. After launch, it isn't refundable.
- To allow more voters than your plan does, upgrade and pay the difference.
- A running election always finishes, even if a payment is disputed or a yearly plan lapses. Until it's resolved, you can't launch new elections or buy new plans.
- If a yearly plan lapses, elections already launched finish normally. Longer record retention from that plan ends 30 days after the lapse, with a warning first.
Availability and changes
- We work to keep ElectionKeeper available and secure, but can't promise it will never be interrupted.
- We may change or improve features. If a change would significantly affect an election you've scheduled, we'll tell you first.
- We'll email you before changes to these terms take effect.
Ending your use
- You can delete your organization or account at any time. Deletion removes its data, as set out in the privacy policy.
- We may suspend or close accounts that break these terms. Where we can, we'll tell you first and let any running election finish.
Our responsibility
- ElectionKeeper is provided as is. We don't promise it will suit every purpose.
- To the extent the law allows, we're not liable for indirect or consequential losses, and our total liability is limited to what you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't be limited by law.
